Terms of Service

These Terms of Service explain the guidelines that apply when you use the Booked N' Balanced website, services, systems, resources, or support. By using our services, you agree to these terms. By accessing our website, purchasing or using our services, or participating in Booked N' Balanced programs, you agree to these Terms of Service and our Privacy Policy. If you do not agree with these terms, please do not use our services.

These terms apply to your use of Booked N' Balanced services unless a separate written agreement between you and Booked N' Balanced states otherwise.

2. Services We Provide

Booked N' Balanced provides business systems, CRM setup and support, workflow and automation services, education, consulting, and related resources designed to help service-based businesses operate more efficiently.

Specific services, features, and deliverables may vary depending on the program, package, membership, or service you select. Details provided in your applicable service agreement, proposal, checkout page, or program materials will help define what is included in your purchase.

3. Accounts and Access

Some Booked N' Balanced services may include access to a client account, CRM platform, training portal, resource library, or other digital tools. You are responsible for maintaining the confidentiality of your login information and for activity that occurs through your account.

Please provide accurate and current account information and notify us if you believe your account or login credentials have been accessed without your permission.

4. Payments and Billing

Prices, payment schedules, and billing terms will be provided at the time of purchase or within the applicable service agreement, proposal, or checkout page.

By purchasing a service or subscription, you authorize Booked N' Balanced and its payment processor to charge the payment method you provide according to the billing terms presented at the time of purchase.

For recurring services or memberships, charges will continue according to the agreed billing schedule until canceled in accordance with the cancellation terms applicable to that service.

5. Cancellations & Refunds

Recurring Booked N' Balanced services and memberships may be canceled at any time before your next billing date. Your cancellation will prevent future recurring charges, and you will continue to have access to the applicable service through the end of the period you have already paid for.

Payments already processed for the current billing period are non-refundable, including partial or unused portions of that billing period.

Cancellation and refund terms for one-time services, setup projects, coaching, training programs, digital products, or other purchases may vary and will be provided at the time of purchase or in the applicable service agreement.

6. Client Responsibilities

To provide our services effectively, Booked N' Balanced may rely on information, materials, access, approvals, or decisions provided by you. You are responsible for providing accurate information and responding to reasonable requests needed to complete or support your services.

You are also responsible for reviewing your business systems, communications, workflows, automations, forms, and other materials to make sure they are appropriate for your business and comply with any laws, regulations, or professional requirements that apply to you.

7. Acceptable Use

You agree to use Booked N' Balanced services, systems, and resources only for lawful business purposes and in a way that does not interfere with the rights, security, or experience of others.

You may not use our services to send unlawful or unauthorized communications, distribute harmful or malicious content, attempt to gain unauthorized access to systems or accounts, misuse third-party platforms, or engage in activities that violate applicable laws or the terms of services you connect to Booked N' Balanced.

8. Intellectual Property

Booked N' Balanced owns or licenses the content, training materials, templates, resources, branding, and other materials we provide unless otherwise stated. These materials are provided for your individual or internal business use and may not be copied, resold, distributed, published, or represented as your own without written permission.

You retain ownership of the business information, content, branding, client information, and other materials you provide to us. Providing these materials to Booked N' Balanced gives us permission to use them as reasonably necessary to provide the services you have requested.

9. Third-Party Platforms & Integrations

Booked N' Balanced may use or connect with third-party platforms and services to provide certain features, such as CRM technology, scheduling, communications, payment processing, email, analytics, and other business tools.

These third-party services are operated independently and may have their own terms, privacy policies, fees, features, availability, and usage requirements. Booked N' Balanced does not control these third-party services and is not responsible for changes, interruptions, limitations, or discontinued features outside of our control.

You are responsible for complying with the terms and policies of any third-party services you choose to connect to or use with your Booked N' Balanced services.

10. Communications

By providing your contact information, you agree that Booked N' Balanced may communicate with you regarding your inquiries, purchases, services, account activity, appointments, support, and other business-related matters.

Marketing or promotional emails and text messages will be sent in accordance with applicable consent requirements. You may unsubscribe from marketing emails using the unsubscribe option provided or opt out of text messages by replying STOP. Message and data rates may apply, and message frequency may vary.

11. No Guarantee of Business Results

Booked N' Balanced provides tools, systems, education, support, and services designed to help you organize and improve your business operations. However, every business is different, and results depend on many factors outside of our control.

We do not guarantee specific business outcomes, including increases in revenue, bookings, leads, client retention, profitability, or other financial or operational results. Your results will depend on factors such as your implementation, participation, business practices, market conditions, and decisions.

12. Disclaimers

Booked N' Balanced services, resources, and educational materials are provided for general business and operational purposes. They are not intended to replace legal, tax, accounting, financial, or other licensed professional advice.

While we work to provide reliable services and useful information, we cannot guarantee that every system, feature, integration, automation, or third-party service will always operate without interruption, delay, or error. You are responsible for reviewing important business processes and maintaining any records or backups appropriate for your business.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Booked N' Balanced will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of our services, including losses related to business interruption, lost revenue, lost data, or the actions or availability of third-party platforms.

To the fullest extent permitted by law, Booked N' Balanced's total liability for a claim related to a particular service will not exceed the amount you paid to Booked N' Balanced for that service during the six months immediately preceding the event giving rise to the claim.

Nothing in these Terms is intended to limit rights or remedies that cannot legally be limited or waived.

14. Termination

You may stop using Booked N' Balanced services at any time, subject to any billing, cancellation, or service terms that apply to your purchase.

Booked N' Balanced may suspend or terminate access to services when reasonably necessary, including for nonpayment, misuse of our services, violation of these Terms, unlawful activity, or conduct that could harm our systems, business, clients, or third-party providers.

When services end, access to certain accounts, systems, resources, or features provided through Booked N' Balanced may also end. You are responsible for exporting or retaining any business information or records you wish to keep before your access ends, when export options are available.

If we make material changes that significantly affect an existing paid service, we may provide additional notice when appropriate. Your continued use of our services after updated Terms become effective will be subject to the revised Terms, except where applicable law requires additional notice or consent.

16. Governing Law

These Terms of Service are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes relating to these Terms or Booked N' Balanced services will be handled in accordance with applicable California law.
